This Privacy Policy does not govern the use, handling, or actions of any other website or company. This Privacy Policy does not apply to information of any kind that we collect by means (including offline means) or from sources other than those specified herein.

As used in this Privacy Policy, “personal information” means any information or set of information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. “Personal information” does not include information that is not associated with an identified or identifiable individual or information that is reported in the aggregate (provided that such aggregated information is not identifiable to a natural person or household), and does not include information as to which identifying characteristics have been removed without means reasonably likely to be used by any person to re-identify the natural person directly or indirectly. Personal information as referred to in this Privacy Policy is intended to encompass both the concepts of “personal data” under the GDPR and “personal Information” under the CCPA.

Use of Attribution’s Site or Services is subject to our Terms of Service (“Terms”) found at attributionapp.com/terms, which is incorporated into this Privacy Policy. The use of our Site or Services acknowledges your agreement to be bound by our Terms.

3. Why We Collect Your Information

  • We may process personal information you provide when you register for services on our Customer Sites (“Registration Data”). The Registration Data may include your name, email address, mailing address, billing address, credit card details, and telephone number or any other information our Customers choose to collect about you. This Registration Data may be processed for the purposes of analyzing the use of our Customer Sites. Our legal basis for processing this Personal Information is the legitimate interests of our Customers (data controller).
  • We may process information relating to transactions that you enter into with our Customers on our Customer Sites, including purchases of goods and services (“Transaction Data”). This Transaction Data may include your Registration Data listed above, as well as the transaction details. This Transaction Data may be processed for the purpose of supplying the purchased goods and services and keeping proper records of those transactions. Our legal basis for processing this Personal Information is the legitimate interests of our Customers (data controller).
  • We may process information provided to us by our Customers about your use of our Customer Sites (“Customer Site Usage Data”). This Customer Site Usage Data may include your browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your use of the Customer Sites and any other actions you take on the sites. The source of this Customer Site Usage Data is our Services to our Customers or data provided by our Customers’ analytics tracking systems. This Customer Site Usage Data may be processed for the purposes of analyzing the use of our Customers’ Sites. Our legal basis for processing this Personal Information is the legitimate interests of our Customers (data controller).
  • We may process information about your use of our Site (“Site Usage Data”). This Site Usage Data may include your browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your service use and any other actions you take on our Site. The source of this Site Usage Data is our analytics tracking systems. This Site Usage Data may be processed for the purposes of analyzing use of our Site. Our legal bases for processing this Personal Information are consent and our legitimate interests, namely monitoring and improving our website and services.
  • We may process our Customers’ account data provided to us by our Customers (“Customer Account Data”). This Customer Account Data may include your name and email address, but may include other personal information our Customers may choose to collect about you. The source of this Customer Account Data is our Customers providing this information as part of implementation and onboarding of our Services. This Customer Account Data may be processed [for the purposes of providing our Services, maintaining back-ups of our databases and communicating with our Customers. Our legal bases for processing this Personal Information are consent and the performance of a contract between our Customers and us.
  • We may process information you provide when you submit an inquiry to us regarding our goods and/or services (“Inquiry Data”). This Inquiry Data may be processed for the purposes of offering, marketing and selling relevant goods and/or services to you. Our legal bases for processing this Personal Information are consent and the performance of a contract between you and us.
  • We may process other information you provide to us when you submit to us regarding goods and/or services (“Correspondence Data”), such as the communication content and metadata associated with the communication. This Correspondence Data may be processed for the purposes of communicating with you and our record-keeping. Our legal basis for processing this Personal Information is our legitimate interests, namely the proper administration of our Site and Services and communications with our users.
  • We may process any of your personal information identified in this Privacy Policy where necessary for the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. Our legal basis for processing this Personal Information is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.
  • We may process any of your information data identified in this Privacy Policy where necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, or obtaining professional advice. Our legal basis for processing this Personal Information is our legitimate interests, namely the proper protection of our business against risks.
  • In addition to the specific purposes for which we may process your personal information set out in this Section, we may also process any of your personal information where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

4. How We Use Information We Collect Through the Service

We use information about you provided to us by our Customers that you provide voluntarily and that is collected automatically when visiting Customer Sites to provide our Services to our Customers; respond to your requests, resolve problems, improve the quality of our Services, and market our products or services and those of third parties to you. With respect to any information that we collect or receive, we may also anonymize such information by removing identifying characteristics (if any) and aggregating it with the information of others. We may use such information to create compilations of aggregated data and/or statistics and reports, and any other uses without restriction. We may use all information about you provided to us by our Customers that is collected when visiting Customer Sites to comply with our legal and regulatory obligations, policies and procedures, and for internal administrative purposes.

If you are a Customer, you are responsible for gathering and maintaining the consent for any individual personal information that you share with us. The sharing of your end customer’s personal information must be made with their informed and unambiguous consent.

5. Collecting Your Information Through Cookies

Our Site and Services use “Cookies” and other unobtrusive technologies. Cookies are small files that are placed on your hard drive to identify you and/or your device. Other technologies may collect the browser type and language, IP address, and links clicked. By using our Site and Services, you are agreeing to the use of Cookies and other technologies for the purposes described in this policy. Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using our Site and Services. Certain features may not function properly without the aid of cookies. The method for disabling Cookies may vary by device and browser.

Our Site and Services do not respond to browser “Do Not Track” (DNT) features that tell the sites you visit that you do not wish to be tracked. Our Customer Sites determine and respond to any DNT features of your browser.

6. Sharing Your Information

We will offer you the opportunity to choose whether your personal information is to be used for a purpose materially different from the purpose for which it was originally collected or subsequently authorized by you. Attribution will not sell or share your personal information except as provided below.

Sharing Personal Information with Our Customers. Attribution collects and processes your personal information for the purposes identified above. We may merge your information with data from other individuals into anonymized group data that is shared with our Customers to provide our Services to our Customers. We do not aggregate or share information with third parties other than our Customers.

Attribution may disclose your personal information: To third party vendors or service providers who help us provide the Services or our Site, including database hosting and data processing services, and assist us in responding to requests by you for information that you request (including your rights covered by the provisions in this Privacy Policy under “Accessing and Controlling Your Personal Information”);

To Affiliates and as Part of an Acquisition or Merger. If Attribution, or substantially all of its assets, are acquired, or we merge with another company, your personal information may be transferred or acquired as part of that transaction. Any acquirer may continue to use your personal information as set forth in the Privacy Policy in effect when you provided your personal information. We may also share your information with a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), provided that we require our Affiliates to honor this Privacy Policy.

As Required by Law. We reserve the right to disclose your personal information as required by law and when we believe that disclosure is necessary to enforce our policies and practices, comply with existing laws or a court order, or in response to legal process served on us.

Emergency. We also reserve the right to disclose your personal information when we believe it’s necessary to prevent imminent and serious bodily harm or financial loss to a person, to prevent fraud, or to protect our rights or property or the rights and property of you or third parties or if we believe in good faith that such disclosure is necessary to (a) resolve disputes, investigate problems, or enforce our Terms or (b) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity or in connection with our own investigation of suspected or actual illegal activity, in which case we may (and you hereby authorize us to) disclose personal information without subpoenas or warrants served on us.

7. Public Forums

We may offer blogs or similar public forums where you and other users of our Site and Services may communicate. The protections described in this Privacy Policy do not apply to information you provide in connection with your use of these public forums. Any information you share in a public forum is public information and you should have no expectation of privacy. It may be seen or collected by anyone, including third parties that do not adhere to our Privacy Policy. We are not responsible for the information you post publicly, or any event arising from the information you choose to publicly post or share through our Site or Services.

Where we collect or receive personal information about you from our Customers, which occurs when we are acting as a provider of Services to our Customers on Customer Sites, we do so as a processor (under GDPR) and/or service provider (under CCPA) of personal information on behalf of our Customers. We will use such information in accordance with the notices provided to you by our Customers and in accordance with the choices you made with respect to such personal information, as communicated to us by our Customers.

9. Protecting Your Information

All data collected through our Site and Services are stored at Amazon Web Services (“AWS”) (https://aws.amazon.com/) and Heroku (https://www.heroku.com/). We use data processing agreements to govern the processing and security of your information stored at these services.

We have adopted reasonable administrative, physical, and technical safeguards to protect against accidental, unauthorized or unlawful access, disclosure, loss, modification, processing or use of your information. This includes, for example, firewalls, password protection and other access and authentication controls. We use SSL technology to encrypt data during transmission through public internet, and we also employ application-layer security features to further anonymize Personal Information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot guaranty the security of any information you transmit to us or that we stored on our Services (including information stored at the third-party services referred to above), and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If you believe your personal information has been compromised, please contact us as set forth in the “Contact Us” section.

10. Links to Third Party Sites

Our Site and Services may contain links to other third party websites (“Other Sites”) that we do not control. You acknowledge that Attribution has no control over Other Sites, their content, or privacy practices. Accordingly, you acknowledge and agree that access to any Other Sites is at your own risk and you indemnify Attribution for any event arising from your visit.

We not responsible for the accuracy, reliability or completeness of any information, data, opinions, advice or statements made on Other Sites. We may provide these links as a convenience and do not endorse, sponsor, or recommend any Other Site, or its products and services.

Other Sites have their own privacy practices and policy independent of Attribution. We highly recommend you review these for each website you visit.

11. Children’s Online Privacy Protection Act Compliance

In compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), our Site and Services are not directed to, or permitted for use by, persons under the age of 13. We have no actual knowledge that personal information is collected from anyone under the age of 13. If we learn that information has been collected from a child under age 13, we will delete it promptly and without notice. If you believe that we might have any information from or about a child under 13, please contact our Privacy Officer as described below.

12. Storing Your Information

We will retain your personal information for as long as necessary to fulfill the purpose(s) for which it was collected and comply with all applicable laws. In that regard, your consent to such retention of your personally identifiable information by Attribution may remains valid after termination of our relationship. However, you may request to have your personally identifiable information deleted by contacting the Privacy Officer as described in Section 14 below.

13. Accessing and Controlling Your Personal Information

We respect that the personal information we collect and process is yours and you may have legal rights.

(For visitors to Customer Sites) When acting as a provider of our Services to our Customers on Customer Sites, Attribution is a Data Processor in respect of personal information about visitors to Customer Sites that Customers provide us. We have no direct relationship with visitors to Customer Sites, and in such cases if you seek access, or seek to correct, amend, or delete your personal information, you should direct your inquiries to the relevant Customer which has transferred such personal information to us for processing. We will assist our Customers in fulfilling their obligations under applicable law to respond to such requests by individuals to access or correct, amend or delete their personal information.

When we process personal information as a Data Controller, you may have certain rights under law. Please work with our Privacy Officer if you have any questions about your rights or how to exercise them.

NOTE: The following rights reflect rights recognized under the GDPR. Additional rights specific to California residents are set forth in a separate section at the end of this Privacy Policy (“Supplemental Privacy Notice for California Residents”).

Opt Out of Marketing Communications If you receive marketing or promotional emails from us, you may unsubscribe at any time by following the instructions contained within the email or by sending an email to the address provided in the “Contacting Us” section.

14. Accountability for Onward Transfer

Our Site is hosted and our Services are provided in the United States of America. In the performance of our Service and business operations, personal information we collect or receive may be stored or transferred internationally throughout our organization and to our service providers or agents, in accordance with applicable data privacy laws. Transfers to third parties are covered by the provisions in this Privacy Policy under Notice and Choice.

We will endeavor to obtain assurances that any such service provider or agent will provide at least the same level of privacy protection as is required by this Privacy Policy and will notify us if it makes a determination it can no longer meet this obligation.

We use model contractual clauses and other mechanisms approved by the European Union and Switzerland, respectively, for transfers of personal information from the European Economic Area and Switzerland.

  • Indirectly from our Customers (or their agents) through our Customers’ use of our Services, including data we collect from our Customers about your use of our Customer’s Sites.
  • Directly and indirectly from activity on our Site. For example, from your communications submitted through our Site’s portals, billing information you provide to us, or Site usage details collected automatically.

Use Of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

    • Sales, identifying the personal information categories that each category of recipient purchased; and

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
